Terms and Conditions for BisB’s Prepaid Cards and Wearable Devices

Definitions

  • Bank: Bahrain Islamic Bank B.S.C.
  • Card: the Prepaid Card issued by the Bank to a Cardholder.
  • Account Holder: means the person in whose name my Kids Account has been opened.
  • Wearable Devices s (“Devices”): a wearable device used to purchase goods and/or services on credit.
  • Card/ Device holder: the person in whose name the Card/ Device is issued, nominated by the account holder and whose Card Transactions are chargeable to the My Kids Account of the Account holder.
  • My kids Account: the account opened with the Bank in the name of the Main account holder in accordance with these Terms and Conditions.
  • Available Funds: the net debit amount available in the Card/ Device Account.
  • Card/ Device Transaction: the purchase of goods and services including but not limited to, Point of Sale (P.O.S.) transactions, ATM withdrawals, online and telephone transactions.
  • Validity Period: the period for which the Card/ Device is valid as determined by the Bank.
  • PIN: the Personal identification Number issued by the Bank for the Card/ Device.
  • BisB Digital: the Bank’s electronic services provided at www.ebisb.com or through BisB Apps available on app stores.

Account Holder’s Obligations

The Account holder, whose has designated the card/ Device, agrees and acknowledges to comply with the following:

  • Refrain from sharing the Card/ Device with any third party, unless authorized by the Bank.
  • Sign on the space provided at the back of the Card immediately upon receipt, in case, where card was required.
  • Safeguard the PIN number (if applicable) and take all the necessary precautions to avoid the disclosure of the PIN number to any unauthorized person, unauthorized website or any other unauthorized channel(s) that may expose the Card/ Device Account for abuse and/or fraudulent transactions, unless such disclosure is necessary for reporting the card/ Device’s loss, theft and/or damage. The Card Device /holder further undertakes to destroy the Bank’s PIN notification upon receipt.
  • Immediately notify the Bank’s Card Centre by calling (+973) 17 515 999 if the Card Number and/or PIN became known to any unauthorized person.
  • Use the Card/ Device within the available funds of the Card Device / Account, in accordance with the limits determined by the Bank from time to time.
  • To comply with the goal/purpose for which the Card/ Device Account has been requested to and avoid using the Card Device / for any illegal transactions as defined by:
    • The payment provider regulations;
    • International Authorities;
    • Laws of the Kingdom of Bahrain; or
    • contrary to Islamic Sharia’a in accordance with the Sharia’a standards issued by the Accounting and Auditing Organization for Islamic Financial Institutions (AAOIFI) and as interpreted by the Bank’s Sharia’a Board.
  • Avoid using the Card Device / after the expiry date stated on the Card Device / as notified by the Bank or after any notification in relation to the cancellation or withdrawal of the Card Device / by the Bank or any of its representatives.
  • Return the Card/ Device to the Bank prior to permanently leaving the Kingdom of Bahrain, upon settling all the outstanding amounts.

Use of Card/Wearable Device

  • Only the designated Card/ Device holder, whose names appear in the My Kids Account, may use the Card/Device. The Card/Device holder agrees to:
    • Sign the Card immediately upon receipt (where applicable).
    • Either keep the PIN in a secret place away from the Card/wearable Device and take all the necessary precautions to prevent others from knowing it; or destroy the PIN notification after memorizing the PIN.
    • Refrain from disclosing the Card number to any unauthorized person.

Card/ Device Account

  • The Bank will open and maintain a Card /Device Account for the account holder to enable him/her to deposit the amounts designated for spending. Any loss incurred by the Bank arising from the use of the Card/ Device will also be charged to this account.
  • The Bank will directly charge to such Card/ Device Account the amounts of all purchases of goods and services or cash withdrawals by use of the Card/ Device where any merchant in the course of a Card / Device Transaction seeks an authorization from the Bank, the amount of such Card/ Device Transaction will reduce the amount of the Available Funds in the Card/ Device Account.
  • The amount of any Card/ Device / Transaction in a currency other than BHD will be converted into the Card/ Device Currency at the prevailing rates of exchange (as specified by the Bank and the Visa/Master Card international) on the date when such amounts are charged to the Card / Device Account. The Bank reserves the right to charge a markup on the currency exchange, as specified by the Bank.
  • If the merchant refunds the Bank the value of the service or merchandise provided to the Card/ Device holder, the Bank shall credit such value to the Card / Device Account upon receipt thereof.
  • The account holder may obtain a detailed statement of account showing the transactions that took place on the Card / Device by logging to the Bank’s BisB Digital Portal at www.ebisb.com.
  • The statement of account shall be considered as accepted by the Card / Device holder if he/she does not object thereto within the specified duration of 15 days from the date of the statement.
  • The Customer acknowledges and agrees that some differences may arise between the amounts in the bills and the amounts in the Bank statement due to rounding the amount figure from three to two decimals or any other reasons as per the Bank’s policy.
  • The Bank shall not be liable in any manner whatsoever for any difference that may arise between any merchant and the Cardholder concerning a Card/ Device Transaction that is the subject of payment. In case any bank, retail, outlet, ATM, point of sale or any other equipment refuses to accept the Card, the Bank shall not be responsible for such refusal. If the retail outlet refunds to the Bank the value of the service provided to the Cardholder, the Bank shall credit such value to the Card Account upon receipt thereof.
  • The kids Account will be credited with a refund in respect of a card/ Device Transaction only in the event the Bank receives verification of the refund that is acceptable to the Bank in its sole discretion.
  • In the event the account holder makes a claim against a third party in respect of a Card / Device Transaction, such claim shall not be subject to an inter-pleader, defense or counterclaim against the Bank.

Card/Device Holder’s Rights

  • The Account holder, may, at his/her discretion, request issue an additional Card/ Device for the use of the Card/ Device holder designated by the Account holder. The Account holder shall be liable for all amounts arising from or losses incurred by the Bank in connection with the use of the kids account by the Card/ Device holder (including any use in breach of these Terms and Conditions which the Bank shall be under no responsibility to prevent) which amounts/losses sustained may be debited to the Account Holder.
  • The Account holder shall be entitled to obtain more than one card / device to be used by his student children as required, after registering their names and personal data in the service application designated for this purpose. The Account holder may also control the ceiling of each card / device and inquire about transactions performed on the same, including their deactivation and / or restriction to a specific place or time.
  • In addition to its other rights and powers under this Agreement, the Bank may cancel the Kids Account / Card/ Device at any time at the written request of the Account holder, accompanied by the return of that Card/ Device to the Bank without affecting the Account holders liability in respect of any Card Transaction conducted by the Card/ Device holder prior to cancellation.

Fees and Charges

  • The Card/ Device will be subject to the following fees and charges, where applicable:
    • Card / Device issuing fees: applicable as of the opening of the Card/ Device Account and the issuance of the Card/ Device.
    • Debit balance retrieval charges to be applicable on any account transfer or issuance of a manager cheque.
    • Card/ Device replacement fees.
    • PIN replacement fees.
  • The Bank shall announce the applicable service fees and charges on its website www.bisb.com and at the branches as deemed appropriate.
  • The Bank reserves the right to determine, add, waive or vary the service fees and charges as per its sole discretion and notify the Card/ Device holder of such change through SMS/Social Media /Website and any other means as deemed appropriate

Suspension or Cancellation of the Card/ Device

  • The Card remains the property of the Bank at all times. On request, all and any Card issued for use on the Card Account must be returned immediately to the Bank.
  • The Bank may at any time suspend or deny the Card holder’s right to use the Card either on temporary or permanent basis upon serving a written notice by way of email and SMS to the Card holder if the latter fails to honor his/her obligations under these Terms and Conditions or any attachments thereto or under any other agreements, amendments, legislations, and/or if he/she defaults in the payment of the amounts as they fall due. Accordingly, the Card = Account shall be automatically terminated and the Card= holder shall hand over the Card to the Bank and refrain absolutely and immediately from using the Card.
  • Such cancellation shall not absolve the Card holder from his/her liabilities and obligations towards the Bank until the date of handling the matter in relation to the Card

Termination

  • The Account holder may terminate the Card/ Device Account by a written notice to the Bank but such termination shall only be in effect upon return of the Card / Device to the Bank and the full settlement of all the liabilities/dues of the Card/ Device holder to the Bank. Until such termination, the Bank may reissue Cards/ Devices where applicable for use in accordance with these Terms and Conditions. Prior to leaving the Kingdom of Bahrain permanently, the Card / Device holder shall return to the Bank the Card/ Device issued by the Bank to the Card/ Device holder.

General Provisions

  • The Bank shall not be liable to any failed authorization of the Card/ Device if such failure is due to the inefficiency of any Point of Sale, data processing system, transmission link, industrial dispute or any other matter that is deemed to be beyond the Bank's control.
  • The account holder shall immediately notify the Bank of any change of his/her personal data/contact details if any.

Applicable Law

  • These Terms and Conditions shall be governed by, and construed in accordance with, the applicable laws of the Kingdom of Bahrain unless such laws conflict with the provisions of the Islamic Shari’a as adopted by the Bank's Shari’a Board in which case the latter shall prevail.
  • In the case of either a claim by the Bank against the Card/ Device holder or a dispute between the Bank and the Card/ Device holder, the Card/ Device holder agrees to irrevocably submit to the non-exclusive jurisdiction of the courts of the Kingdom of Bahrain.

Variation of these Terms and Conditions

  • The Bank reserves its right to amend these Terms and Conditions at any time.
  • The Bank shall notify the Card/ Device holder regarding any amendment by any means as deemed appropriate by the Bank.
  • Continuation of using the Card/ Device by the Card / Device holder after the above mentioned notification shall be considered as an irrevocable acceptance of these amendments.
  • These Terms and Conditions have been drafted in English and Arabic. In the case of conflict between the English and Arabic versions of these Terms and Conditions, the Arabic version shall prevail.
