Credit Card Terms and Conditions

Definition

  • “Primary Cardholder” refers to the person in whose name the Credit Card Account has been issued.
  • “Supplementary Credit Cardholder” refers to a Credit Cardholder nominated by the Primary Cardholder and whose Card Transactions are chargeable to the Credit Card Account of the Primary Cardholder.
  • “Cardholder” refers to the Primary Cardholder and Supplementary Cardholder.
  • “Bank” refers to Bahrain Islamic Bank B.S.C.
  • “Card” refers to the Credit Card issued by the Bank to a Cardholder.
  • “Card Account” refers to the account opened with the Bank under the name of the Primary Credit Cardholder in accordance with the Credit Agreement.
  • “Card Limit” refers to the maximum debit balance permitted on the Card Account as determined and notified by the Bank to the Primary Credit Cardholder from time to time.
  • “Card Statement” refers to a monthly statement of the transactions performed on the Credit Card during the previous billing period.
  • “Card Transaction” is the purchase of goods, obtainment of services, or cash advance by the use of the Card.
  • “Cash Advance” refers to any cash withdrawal within the Credit Card Limit set by the Bank, paid over-the-counter or by Automated Teller Machines (ATM) to the extent of the credit limit set by the Bank to the Cardholder through use of the Card.
  • “PIN” is a Personal Identification Number issued by the Bank to the Cardholder.
  • “Validity Period” refers to the period for which the Credit Card is valid as determined by the Bank.
  • “Merchant” refers to any merchant establishment/business organization/ service provider, which accepts the Card in payment of goods and/or services.
  • “Easy Monthly Installment (EMI)” refers to any transaction conducted on the Credit Card by the Cardholder for which the Cardholder utilizes the Card Limit and repays the Transaction amount in equal monthly installments.  
  • “Use of Third-Party Mobile Wallet Services” refers to the terms and conditions that govern the addition and use of the Cardholder’s Card using a third-party mobile wallet service. These Terms and Conditions apply in addition to the Credit Card Terms and Conditions for transactions made via such mobile wallet services. 

Use of the Card(s)

Only the designated Cardholder, whose name appears on the Credit Card, may use the Card. The Cardholder agrees to:

  • Sign the Credit Card immediately upon receipt.
  • Either keep the PIN in a secret place away from the Card and take all necessary precautions to prevent others from knowing it; or destroy the PIN notification after memorizing the PIN.
  • Use the Card within the Card Credit Limit determined and notified by the Bank from time to time, any excess over the Card Limit being immediately repayable in full to the Bank; in addition to the over limit fee as mentioned in clause 5 below.
  • Refrain from disclosing the Credit Card number to any unauthorized person or entity.
  • Refrain from using the Credit Card for any unlawful, and illegal transactions, as defined by (a) the payment provider regulations; (b) International Authorities; (c) Laws of the Kingdom of Bahrain; or (d) contrary to Islamic Sharia’a in accordance with the Sharia’a standards issued by the Accounting and Auditing Organization for Islamic Financial Institutions (AAOIFI) and as interpreted by the Bank’s Sharia’a Board.
  • Not to use the Credit Card after the period for which it is stated to be valid or after notification to notify of its termination or withdrawal by the Bank or any person acting on behalf of the Bank.

Safeguarding the Card and PIN

  • The Credit Cardholder must exercise all possible care to ensure the safety of the Card and will safeguard the PIN code from disclosure to any person or entity. The Cardholder must not disclose the Card Number to any third party except in connection with a Card Transaction or when reporting the actual loss or theft of the Card.
  • If the Card is lost or stolen or damaged or if there is a reason to suspect that the PIN has become known to any unauthorized person, the Cardholder shall immediately notify the Bank’s Card Centre, any branch of the Bank, or by calling 17-515151, or by email at Callcentre@bisb.com or by mail to P.O. Box 5240, Manama, Kingdom of Bahrain. The Bank’s liability to the transactions undertaken on the Card shall be effective as of the date of the Cardholder’s notification of the Card’s loss, damage, or theft, as clarified above.

Card Account

  • The Bank will open and maintain a Credit Card Account for each Primary Credit Cardholder and will charge to such Card Account the amounts of all goods and services (“purchases”) and of cash advances obtained by use of the Card and any loss incurred by the Bank arising from the use of the Card.
  • Where a retailer or Merchant in the course of a Card Transaction conducted by the Credit Cardholder seeks an authorization from the Bank, the amount of such transactions will be deducted from the available Credit Card limit in the Credit Account. The amount of any Card transactions in a currency other than Credit Card Account currency will be converted into the Card Account original currency at the prevailing rates of exchange (as determined by the payment providers) on the date when such amounts are charged to the Card Account.
  • The Bank shall not be liable in any manner whatsoever for any difference that may arise between any Merchant and the Cardholder concerning a Card Transaction that is the subject of payment. In case any bank, retail outlet, ATM, point of sale, or any other equipment refuses to accept the Card, the Bank shall not be responsible for such refusal. If the retail outlet refunds to the Bank the value of the service provided to the Cardholder, the Bank shall credit such value to the Card Account upon receipt thereof.
  • The Card Account will be credited with a refund in respect of a Card Transaction only in the event the Bank receives verification of the refund acceptable to the Bank in its sole discretion.
    In the event the Cardholder makes a claim against a third party in respect of a Card Transaction, such claim shall not be subject to an inter-pleader, defense, or counterclaim against the Bank.
  • The Bank shall send monthly Card Statements/eStatements for the Card Account to the Primary Cardholder to the Cardholder’s address/email as it appears on the application form or any subsequent written amendment thereto. The statement’s data shall be considered as accepted by the Primary Credit Cardholder if he/she does not object thereto within the specified duration of 15 days from the date of the statement. The Cardholder shall pay within 25 days from the date of each statement the minimum sum as provided in each statement or any higher amount as determined by the Cardholder, the minimum sum will be 5% of the outstanding balance subject to a minimum amount of BHD 10.
  • The Cardholder shall not be entitled to assign or otherwise transfer any rights under the card to any third party. The Bank shall not be liable to the Cardholder in the event a third party declines to honor the Card.
  • The Primary Credit Cardholder must pay immediately any arrears of previous payments and the amount of any Card Transaction made in breach of any Terms and Conditions of this Agreement.
  • The Credit Cardholder irrevocably authorizes the Bank to debit any other Account of the Primary Credit Cardholder with the Bank towards recovery of any arrears of payments and/or penalties that the Bank may impose for any Card Transaction made in breach of any of these Terms and Conditions.
  • All amounts due under these Terms and Conditions will be immediately payable in full on the commission of an act of Bankruptcy by, or on the death of the Primary Cardholder or, at the Bank’s discretion, if there is any breach to these Terms and Conditions by the Cardholder. In case of the death or bankruptcy of the Primary Credit Cardholder, the obligations of the Primary Cardholder will remain in full force and effect until such time as they are duly satisfied.
  • Any payments made to the Bank and credited to the Card Account shall be used by the Bank in the following manner : (1) towards the Easy Monthly Installment Amount, which includes the installment and the installment service fees (as stipulated in the Bank’s Fees and Service Charges);  (2) for the payment of late payment amounts and any other applicable fees; (3) towards payment of all cash advances as shown in the latest and any previous statements; (4) for the payment of all purchases shown in any previous statement; (5) towards the payment of all purchases shown in the latest statement; and (6) for the payment of any cash advances made and debited to the Card Account but not yet shown in any statement.
  • The Cardholder acknowledges that some differences may arise between the amounts in the bills and the amounts in the Bank statement due to rounding amount figure three to two decimals or any other reasons related to VISA International and MasterCard Worldwide terms and conditions, and he/she covenants to exempt the Bank from any liability in this matter.

Fees and Charges

The Cardholder must on a monthly basis pay a fixed Service fee as stated below of the outstanding balance after deduction of payments. These fees are determined according to the differences in benefits and services obtained by the Cardholder. The Bank has the right to either waive a percentage of the entire monthly Service fee amount depending upon the Cardholder’s compliance with making payment of the outstanding amounts owed by him in whole or in part on or before the due date fixed at 25 days with effect from the Statement of Account’s date.

Card Service Fee

  • Gold: BD 1,080 per annum | BD 90 per month
  • Titanium: BD 2,040 per annum | BD 170 per month
  • Platinum: BD 3,060 per annum | BD 255 per month
  • Black & Signature: BD 6,000 per annum | BD 500 per month
  • Infinite: BD 14,500 per annum | BD 1,200 per month
  • Cashback Card: BD 2,040 per annum | BD 170 per month

Maximum Card Limits

  • Classic/Gold: BD 5,000
  • Titanium: BD 10,000
  • Platinum: BD 15,000
  • Signature & Black: BD 30,000
  • Infinite: BD 75,000
  • Cashback Card: BD 10,000
  • On any Cash Advance (branch counters and ATM’s of Bahrain Islamic Bank are not permitted and cannot be used), the Cardholder must pay a handling fee of 4% flat of the cash amount withdrawn subject to a minimum fee of BHD 4.
  • The total amount of Card Transactions per month shall be reflected in the Card Statement, including the fees, and shall be reduced from the available Card Limit.
  • The Cardholder must pay a minimum of 5% of the total outstanding amount subject to a minimum amount of BHD 10.

The Bank reserves the right to vary all of the above charges, percentages, or other fixed fees from time to time at its sole discretion. The Bank shall notify the Cardholder of any amendment at his/her mentioned address in writing or by displaying a notice at the branch where the Card Account is maintained.

A flat fee of BD 5 (assigned for charity purposes)  will be charged if the Credit Cardholders use the Card in excess of their granted Credit Limit.

A flat late payment fee of BD 5 (assigned for charity purposes) will be charged to the Card Account if the minimum sum due is not received by the Bank on or before the due date.

Supplementary Cardholder

  • The Bank may, at its discretion, issue a Supplementary Card at the written request of the Primary Credit Cardholder for the use by any member of the Primary Credit Cardholder’s immediate family exceeding 15 years old, who are (Parents, Spouse, dependents/Children) and/or any other beneficiary of the card, as approved by the Bank from time to time, as an additional Cardholder. The Primary Credit Cardholder shall be jointly and severally liable for all amounts arising from or losses incurred by the Bank in connection with the use of the Credit Card Account by the Supplementary Cardholders (including any use in breach of these Terms and Conditions which the Bank shall be under no responsibility to prevent) which amounts/losses sustained may be debited from the Credit Card Account.
  • In addition to its other rights and powers under this Agreement, the Bank may cancel any additional Credit Card at any time at the written request of the Primary Cardholder, accompanied by the return of that Card to the Bank without affecting the Primary Cardholder’s liability in respect of any Card Transaction conducted by the Supplementary Cardholder prior to terminating the Credit Card.

Direct Debit Service

  • Should the Primary Cardholder request to be enrolled in the Direct Debit Service and after verification of the Direct Debit form, the Bank shall arrange to enroll the Primary Cardholder in the service. The Bank shall arrange to debit the Cardholder’s savings or current account any amounts requested by the Cardholder provided that there are sufficient funds in the account.
  • The Bank will execute the Direct Debit Service 10 days after the statement date up to the due date and will cease should the minimum amount due be settled on any day after the statement date.
  • If the Cardholder pays a partial of the amount due, this shall not forfeit the right of the Bank to debit the remaining amount due.
  • The Cardholder shall be responsible for the appropriate service charges indicated in Clause 5 of these Terms and Conditions if the Bank is unable to debit the amount due to instability of the account or should there be insufficient funds in the Account.
  • The Direct Debit Service will continue to be operational by the Bank unless a written instruction is received to terminate the service, through the Bank’s Internet banking or open banking platform, 20 days prior to the due date appearing on the current credit card statement.

Suspension and Termination of the Credit Card

  • The Card(s) remain(s) the property of the Bank at all times. On request, all and any Card(s) issued for use on the Card Account must be returned immediately to the Bank or any other person acting for the Bank.
  • The Bank may at any time suspend or terminate the right of the Cardholder to use the card, on a temporary or permanent basis without any notice, if the Cardholder fails to satisfy their obligations under these Terms and Conditions or any attachments thereto or under any other Agreements or amendments, and/or if they default in the payment of the amounts as they fall due. Accordingly, these Terms and Conditions shall automatically terminate, and the Cardholder shall hand over the Card to the Bank and refrain absolutely and immediately from using the Card. Such termination shall not absolve the Cardholder from their liabilities and obligations towards the Bank.
  • The debit balance of the account of the Cardholder shall continue in force and fees and charges shall accrue as agreed between the two parties herein until the debit balance of the Card Account is finally settled. In the event of death, bankruptcy, or default of the Primary Cardholder, the Bank may in addition to any other remedies it may decide, take such steps as are necessary to restrict any right of use of the Card including withdrawal of the Card(s).
  • The Bank reserves the right to renew/vary the Card Limit of the Card Account from time to time upon notifying the Cardholder at his/her registered address.

Termination

The Primary Cardholder may terminate the Credit Card Account by a written notice to the Bank, but such Termination shall only be in effect upon the return of the Card to the Bank and the full settlement of all liabilities of the Primary Cardholder to the Bank. Until such Termination, the Bank may reissue Cards from time to time for use in accordance with these Terms and Conditions. Prior to leaving the Kingdom of Bahrain permanently, the Primary Cardholder shall return to the Bank all Card(s) issued by the Bank to Cardholder(s).

General Provisions

  • The Bank will not be liable if it is unable to perform its obligations under these Terms and Conditions due (directly or indirectly) to the failure of any machine, data processing system, transmission, link industrial dispute, or any reason beyond the Bank’s control.
  • If the Bank is unable to produce or send a statement, the Primary Cardholder’s liability for total outstanding shall continue and for the purpose of calculating any fees or charges and establishing the date on which payment is due, the Bank may select a set date in each month as the statement’s date. It is the Cardholder’s responsibility to check with the Bank on the relevant set date each month if the cardholder is not in receipt of the monthly statement for the amount payable and as to the deadline within which such remittance is to be effected.
  • The Bank shall not be responsible for the quality, quantity and/or performance of the goods or services availed using the Card. The Cardholder agrees to not withhold payment of the charge because of any claim or dispute with the Merchant.
  • The Cardholder agrees to indemnify and hold the Bank harmless against all claims, demands, actions and/or proceedings which may be made against the Bank and in respect of any or all damages, liabilities, losses, costs and expenses (including legal fees/costs) which may be directly or indirectly incurred and sustained by the Bank, due to the use or misuse of the Card, negligence or breach of these Terms and Conditions or any matter arising out of or in connection with these Terms and Conditions.
  • The Bank should be notified immediately of any change made to the Cardholder’s name, contact number, and address.
  • The Cardholders may request the complaint guideline from any of the Bank’s offices in the event of any unsatisfactory services.
  • The Cardholders will be liable for all card transactions, cash advances, and charges to the card by others if they share the card’s details, including the PIN, with others.
  • If the Bank, on behalf of the Primary Cardholder, enters into any Agreement with Takaful insurance companies and other international institutions for the procurement of certain benefits to the Primary Cardholder, it will be the sole responsibility of such companies and institutions to execute those benefits.
  • The Cardholder undertakes to donate any surplus in the life insurance premium (if applicable) to the Bank’s Investment Risk Fund.
  • The Primary Cardholder accepts full liability for all losses incurred and for all debits to his or her Card Account in accordance with these Terms and Conditions. Any other facilities or benefits made available to Cardholders and not forming part of these Terms and Conditions may be withdrawn at any time without notice by the Bank.
  • The Cardholder acknowledges that from time to time the Bank uses services of third parties (service providers) for processing certain transactions which entail transmitting certain Cardholder’s information. For this purpose, the applicant hereby irrevocably and unconditionally authorizes and provides their full consent to the Bank to transmit his/her information to such service providers.
  • The Applicant/Cardholder acknowledges the Bank’s right to share the paper/digital application form and the related documents with any party as deemed appropriate. The Applicant/Cardholder further authorizes the Bank to inquire any necessary information related to their financial position from any bank/official authority, and share their information with Benefit and/or any other authority as per the Personal Data Protection Law.
  • The Bank may grant the Cardholder from time to time, and subject to its absolute discretion, additional privileges and services to those provided in these Terms and Conditions. Such are to be utilized by the Cardholder prior to the card’s cancellation; otherwise, the Cardholder is deemed to have waived these privileges and benefits.
  • The Bank has the right to deduct any amounts from the applicant’s accounts to cover VAT, and any other taxes or levies that may be imposed by the competent authorities.
  • These terms and conditions shall apply to any replacement Card or renewal Card issued.
  • The Bank reserves the right to cancel or amend these terms and conditions at any time as per the Bank’s sole discretion by giving a minimum of 30 days’ notice. Any amendments to the terms and conditions will be notified to the Cardholder as deemed appropriate by the Bank in line with the CBB guidelines.
  • The Cardholder may add their Card to a digital wallet, subject to the Bank’s approval at its discretion. The Cardholder’s use of the Card in the digital wallet shall be subject to the terms and conditions of the Use of Third-Party Mobile Wallet Services.

Applicable Law

  • These Terms and Conditions shall be governed by, and constructed in accordance with, the applicable laws of the Kingdom of Bahrain.
  • In the case of either a claim by the Bank against the Cardholder or a dispute between the Bank and the Cardholder, the Cardholder agrees to irrevocably submit to the non-exclusive jurisdiction of the courts of the Kingdom of Bahrain.
  • The interpretation, implementation, and adjudication of any dispute that may arise in relation to these Terms and Conditions shall be subject to the Sharia’a standards issued by the Accounting and Auditing Organization for Islamic Financial Institutions (AAOIFI) and as interpreted by the Bank’s Sharia’a Board.
  • These Terms and Conditions are made in both Arabic and English languages; the Arabic text shall prevail in case of any discrepancy with the English text.

I declare that I am over 21 years of age, and that the information stated in the application is true and correct to the best of my knowledge, and in the event that the details I have submitted change, I agree to notify the Bank in writing of such change. I declare that I have received a copy of BisB General Terms and Conditions relating to the Bank’s cards which I have read, understood, and accept any changes to the terms and conditions thereafter as deemed appropriate by the Bank. I authorize Bank and/or its authorized representative to contact and verify my information with my bankers or any other source to obtain any information it may require, as per the governing laws in the Kingdom of Bahrain.

I understand that the Bank reserves the right to require a guarantee acceptable to them or cash margin (which shall be held as collateral and will be used towards settlement of my Card Account(s) as Bank may deem necessary) as a condition of approving this application. I further understand that Bank has the right to decline this application without giving any reason.
